Terms of Use
These terms govern your use of the NOME mobile application. By installing or using NOME you agree to them. If you do not agree, please do not use the app.
Licence
Happenin Labs grants you a personal, non-exclusive, non-transferable, revocable licence to install and use NOME on devices you own or control, for personal or commercial musical practice and performance.
You may not sell, rent, sublicense, or redistribute the app, nor reverse engineer, decompile, or attempt to derive its source code except to the extent this restriction is prohibited by applicable law.
Acceptable use
Use NOME lawfully. Do not use it in any way that infringes the rights of others or violates applicable law. Do not attempt to interfere with or disrupt the app's operation on devices belonging to other people.
Feedback you send
NOME includes a form for sending us feedback. Please keep confidential information, details about other people, and anything you would rather we did not read out of it.
Sending a message allows us to read it, act on it, and use it to improve NOME. We claim no ownership of anything else you make with the app, and we will not publish your message or your email address.
Accuracy and fitness for purpose
NOME schedules its clicks against your device's audio clock and is designed to be accurate, but timing ultimately depends on your device's hardware, operating system, audio routing, and system load. Bluetooth audio in particular introduces latency outside the app's control.
Do not rely on NOME as a precision timing reference for recording, synchronisation, broadcast, or any purpose where a timing error could cause loss or damage. It is a practice tool.
Hearing safety
NOME produces sound through your device's output at the volume you set. Prolonged exposure to loud audio, particularly through headphones, can damage your hearing. Set a comfortable level and take breaks. You are responsible for the volume at which you use the app.
No warranty
NOME is provided "as is" and "as available", without warranty of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or compatible with every device.
Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
Limitation of liability
To the fullest extent permitted by law, Happenin Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or musical opportunity, arising out of or relating to your use of or inability to use NOME.
Some jurisdictions do not allow the limitation of liability for certain damages, so parts of this section may not apply to you.
Third-party components
NOME includes open-source software and the Barlow Condensed typeface, licensed under the SIL Open Font License 1.1. Those components remain the property of their respective authors and are governed by their own licences, which are acknowledged in the app under Menu › About. Nothing in these terms limits your rights under those licences.
Apple App Store
If you obtained NOME from the Apple App Store, you acknowledge that these terms are between you and Happenin Labs only, not with Apple, and that Happenin Labs alone is responsible for the app and its content.
Apple has no obligation to furnish any maintenance or support for the app and is not responsible for addressing any claim relating to it, including product liability, any failure to conform to a legal or regulatory requirement, or claims arising under consumer protection or similar legislation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Changes
We may update NOME and these terms over time. Revised terms take effect when the version of the app containing them is released. Continuing to use the app after an update constitutes acceptance of the revised terms.
Termination
This licence ends if you stop complying with these terms, and ends at any time you choose by deleting the app from your devices.
Governing law
These terms are governed by the laws of the State of Utah, United States, without regard to its conflict-of-law rules, except where mandatory consumer protection law in your country of residence provides otherwise.
